Rules for using MemoryApp, paid plans, analytics, monitoring, testimonials, and support.
These Terms govern access to the public site, account system, gameplay features, analytics dashboards, testimonials, blog articles, payment flows, error monitoring, support channels, and future service updates. If local consumer law gives you protections that cannot lawfully be limited, those protections still apply.
What this agreement covers.
MemoryApp is a digital cognitive-training platform that provides browser-based games, progress tracking, account management, analytical dashboards, admin operations, testimonials collection, blog articles, paid upgrade options, and optional error monitoring. It is intended for skill practice, self-directed training, engagement analytics, and informational progress tracking only.
No medical, clinical, or emergency service.
- MemoryApp is not a medical device and does not provide diagnosis, treatment, monitoring, or emergency services.
- Cognitive scores and performance metrics are for training and self-assessment purposes only, not medical evaluation.
- The service is not a substitute for professional medical, psychological, psychiatric, or educational advice.
- If you have a medical or mental health concern, seek qualified professional help rather than relying on this service.
Who may use the service.
- You must be legally able to enter into a binding agreement in your jurisdiction.
- You must meet the minimum age for digital-service consent in your location, or use the service only with permission from a parent or legal guardian where local law allows.
- You may not use the service if doing so would violate applicable law or sanctions restrictions.
Registration and account responsibility.
- You are responsible for providing accurate account information and keeping login credentials confidential.
- You are responsible for activity that occurs under your account unless caused by our own security failure.
- You must promptly notify us if you believe your account has been accessed without authorization.
- We may suspend or protect an account when reasonably necessary to investigate abuse, fraud, or security incidents.
- Your unique username is assigned to your account and cannot be transferred or shared.
What you may not do.
- You may not interfere with the service, reverse engineer protected systems except where law prohibits restricting that right, scrape restricted areas, or bypass paywalls or access controls.
- You may not use the service to infringe intellectual property, abuse support channels, upload harmful code, automate fraud, or impersonate another person.
- You may not use another person's account without permission.
- You may not exploit bugs, replay payment flows, falsify purchase state, or otherwise manipulate entitlement systems.
- You may not submit false or defamatory testimonials, or submit testimonials using someone else's name or likeness without authorization.
- You may not attempt to abuse rate-limiting systems or make excessive API requests to disrupt the service.
How submitted material is treated.
- You retain rights you already have in material you submit to us, subject to the rights needed for us to operate, review, store, and respond to that material.
- If you submit a testimonial with consent to publish (allowPublish = true), you represent that you are at least 18 years old or have obtained parental/guardian consent, and you grant us a perpetual, worldwide license to use your name, role, rating, and testimonial text in marketing materials, on our website, and on social media.
- If you send suggestions, feature ideas, bug reports, or product feedback, you allow us to use that feedback without a separate payment obligation unless law says otherwise.
- You must have the rights needed to submit any content or communication you provide, and you represent that testimonials are truthful and not defamatory.
- You may request removal of a published testimonial at any time by contacting support.
Ownership and limited use.
The service, including software, design, branding, graphics, content selection, blog articles, game mechanics, and product materials, is owned by or licensed to the MemoryApp operator and is protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-exclusive right to use the service for its intended purpose.
Free access, paid plans, taxes, and promotions.
- MemoryApp may offer free access, paid plans (monthly, annual), trials, promotional discounts, and lifetime or recurring plan structures.
- Plan availability, feature limits, and pricing may change prospectively.
- Taxes, exchange handling, banking fees, or local payment charges may apply depending on your location and payment method.
- Promotional offers and coupons may be time-limited, user-limited, plan-limited, or revoked if misused.
- Trial periods may be offered with terms disclosed at signup; trials convert to paid plans unless cancelled before the conversion date.
Recurring charges, trials, and provider handling.
- If you purchase a recurring subscription, you authorize the relevant payment provider to charge the payment method you select according to the plan terms shown at checkout.
- Trials may convert into paid access if the plan disclosed at checkout says they do so, unless cancelled before the conversion point.
- Some cancellation, renewal, or billing-management actions may currently be handled through support or the payment provider rather than a self-service billing portal.
- You are responsible for keeping billing details current if your payment provider requires updates.
- Payment events are logged and stored for audit and reconciliation purposes.
How refund and cancellation questions are handled.
- Except where required by law, stated at checkout, or approved by us in writing, fees are generally non-refundable once paid access is granted or a billing period begins.
- Refund eligibility may depend on plan type, payment-provider rules, fraud review, duplicate charges, technical failure, or mandatory consumer law in your jurisdiction.
- If your local law gives you a withdrawal, cooling-off, or cancellation right that cannot lawfully be waived, that right remains available to you.

How analytics, monitoring, and admin dashboards work.
- We track gameplay metrics, scores, reaction times, cognitive performance, and engagement to provide you with progress insights and personalized statistics.
- We may analyze aggregated (non-identifying) gameplay data to improve game difficulty, balance, and user experience.
- Administrative users with appropriate roles can access analytics dashboards showing user engagement, game performance, retention metrics, and subscription data.
- All admin actions are logged and audited for security and compliance purposes.
- We use Sentry to capture crash reports, error messages, and performance data to improve service reliability (when enabled in production).
- By using the service, you consent to this analytics, monitoring, and tracking for service improvement purposes.
How blog articles and content are provided.
- We publish blog articles, educational content, and training materials for informational and educational purposes only, not as medical advice.
- Blog content is optimized for search engines and answer engines (LLMs), and may be cited, reproduced, or included in AI training datasets by third parties, which we cannot control.
- Blog content is provided as-is and is not guaranteed to be medically accurate, complete, current, or suitable for any particular purpose. Nothing in our blog constitutes professional medical, psychological, psychiatric, or clinical advice.
- If our blog content discusses health, cognitive training, or memory improvement, you should consult qualified healthcare professionals before making health-related decisions based on our content.
- We may update, remove, or archive blog articles at any time without notice or liability.
Change, downtime, and beta features.
- We may modify, suspend, or discontinue all or part of the service, including individual games, plans, or features.
- We may release tests, previews, beta tools, or experimental features that are offered as-is and may change or disappear at any time.
- We do not guarantee uninterrupted availability, exact uptime, or that every feature will remain permanently unchanged.
- We may deprecate or remove admin features, analytics dashboards, or other functionality with reasonable notice.
How privacy ties into these terms.
Your use of the service is also governed by our Privacy Policy, which explains how account, gameplay, analytics, testimonials, support, monitoring, telemetry, and billing-related data are collected and processed. By accepting these Terms, you also accept the Privacy Policy.
How access may end or pause.
- You may stop using the service at any time and may request account deletion by contacting support.
- We may suspend or terminate access if we reasonably believe you violated these Terms, created security risk, engaged in fraud, used the service unlawfully, or violated our acceptable use policy.
- Upon account deletion, we will remove personal data according to our privacy practices, though some data may be retained for legal compliance or security purposes.
- Where practical, we may preserve records needed for security, legal compliance, payment reconciliation, or dispute resolution after termination.
What is not guaranteed.
- To the fullest extent permitted by law, the service is provided on an as-is and as-available basis.
- We do not warrant that the service will always be error-free, uninterrupted, secure, or suitable for every personal objective.
- We do not guarantee any specific cognitive outcome, academic result, health outcome, productivity gain, or performance improvement.
- Analytics data and cognitive scores are estimates only and should not be relied upon for medical or clinical purposes.
- Sentry error monitoring and session replays are provided for debugging purposes and are not guaranteed to capture all errors or issues.
How liability is limited where the law allows.
To the fullest extent permitted by law, the MemoryApp operator and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunity arising from or related to the service.
To the fullest extent permitted by law, our aggregate liability for claims related to the paid service will not exceed the amount you paid to us for the relevant service during the twelve months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded, including certain consumer, fraud, injury, or statutory rights where applicable.
When you may need to cover losses caused by unlawful use.
To the extent permitted by law, you agree to indemnify and hold the MemoryApp operator harmless from claims, losses, and expenses arising from your unlawful use of the service, violation of these Terms, infringement of another person's rights, or submission of false or defamatory testimonials.
How dispute handling is framed globally.
Operating Entity and Jurisdiction: MemoryApp is operated by an entity based in India. The primary operating entity, business address, and registered jurisdiction are in India. As the service expands to additional jurisdictions, we may establish local operating entities, subsidiaries, or agents in those regions, and we may update these Terms to reflect those changes.
These Terms are intended to apply globally. Unless mandatory local law requires a different outcome, disputes should first be raised through hello@memoryapp.co.in or the contact page so the issue can be reviewed informally and in good faith.
These Terms and the relationship between you and MemoryApp are governed by and construed in accordance with the laws of India, without regard to its conflicts of law principles. You agree that any dispute, controversy, or claim arising out of or relating to these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts located in India (specifically, courts in Mumbai, India). If mandatory consumer-protection, data protection, or other protective law in your place of residence gives you additional protections that cannot be waived, those protections remain in effect notwithstanding this governing law and jurisdiction clause.
How these terms may change.
We may update these Terms from time to time. Changes will apply prospectively after posting unless a different effective date is stated. Continued use after an update takes effect means you accept the revised Terms.
